Terms of Service

Welcome to Kinoseed. These Terms of Service (“Terms”) govern your access to and use of the Kinoseed platform, including the web application, APIs, and any related services (collectively, the “Service”). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You represent that you have the legal capacity to enter into these Terms.

2. Accounts

You may create an account using a supported third-party identity provider (e.g. Google or GitHub). You are responsible for safeguarding access to your account and for all activity that occurs under it.

3. Credits and billing

The Service uses a credit-based pricing model. Each generation consumes a fixed amount of credits. Subscriptions refill credits monthly; credit packs are one-time purchases. Failed generations are automatically refunded. Subscription fees are non-refundable except as required by law. Pricing is published on our pricing page and may change with reasonable notice.

4. Acceptable use

You may not use the Service to create or distribute content that:

  • infringes the intellectual property or privacy rights of others;
  • depicts sexual content involving minors;
  • impersonates a real person without consent (including non-consensual deepfakes);
  • incites violence, harassment, or unlawful activity;
  • contains malware or is otherwise designed to harm our infrastructure;
  • circumvents the credit system or other access controls.

We may suspend or terminate accounts that violate this section, and may cooperate with law enforcement where required.

5. User content and ownership

You retain ownership of the content you upload and the outputs you generate, subject to the underlying model providers' terms. You grant Kinoseed a limited license to host, store, and display that content as necessary to operate the Service. You are responsible for ensuring you have the rights to any reference media you upload.

6. Service availability

The Service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted access, and may modify or discontinue features at any time.

7. Limitation of liability

To the maximum extent permitted by law, Kinoseed will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service. Our aggregate liability for any claim is limited to the amounts you paid us in the twelve months preceding the claim.

8. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if required by law.

9. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use after changes take effect constitutes acceptance.
